Terms of Service

1. Who we are

FlowKreator (https://flowkreator.com) is owned and operated by Shahariaz Ahmed Rhidoy, operating as an individual / sole proprietor (referred to as "FlowKreator", "we", "us" or "our"). You can reach us at support@flowkreator.com.

These Terms of Service (the "Terms") are a binding agreement between you and FlowKreator. They govern your access to and use of the FlowKreator website, web application, hosted creator sites and related services (together, the "Service"). By creating an account, purchasing a plan or otherwise using the Service you agree to these Terms, our Privacy Policy and our Refund & Cancellation Policy.

2. The Service

FlowKreator is self-serve software for creators. A subscription gives you a hosted, branded creator site with the tools to publish a merch shop, members-only video, a public sponsor rate card and a portfolio under one link. Which features are available depends on the plan you subscribe to, as described on our Pricing page.

FlowKreator provides the software and hosting. Every plan is self-serve software: we do not create content, products or marketing material on your behalf, and no plan includes human services.

We may add, change or remove features over time. If a change materially reduces the core functionality of your paid plan, we will tell you in advance and you may cancel under section 5.

3. Accounts and eligibility

You must be at least 18 years old, or the age of majority where you live, to create an account and purchase a plan. You are responsible for keeping your login credentials confidential and for all activity under your account, including activity by team members you invite.

You must provide accurate account information and keep it up to date. We may suspend or close accounts that were created with false information or that are used in breach of these Terms.

4. Plans, billing and payments

4.1 Plans and prices

Current plans, their features and their prices are listed on our Pricing page. All prices are stated in US dollars (USD). Depending on your location, Paddle may charge applicable sales tax, VAT or similar taxes on top of the listed price, and may display the price in your local currency at checkout.

4.2 Subscriptions and automatic renewal

Plans are sold as recurring subscriptions, billed either monthly or yearly depending on the billing cycle you choose at checkout. Your subscription renews automatically at the end of each billing period, and the payment method on file with Paddle is charged the then-current price for your plan, unless you cancel before the renewal date. Paddle sends a receipt for every charge to the email address you used at checkout.

4.3 Changing plans

You can upgrade or downgrade your plan at any time from your account's billing settings. Upgrades take effect immediately and any difference in price is prorated for the remainder of the current billing period. Downgrades take effect at the start of the next billing period.

4.4 Price changes

We may change plan prices from time to time. Any price change applies from your next renewal and we will give you at least 30 days' notice by email before a price increase takes effect, so you can cancel if you do not agree to the new price.

4.5 Failed payments

If a renewal payment fails, Paddle will retry the charge and notify you. If payment is still unsuccessful after the retry period, your plan may be downgraded or your access to paid features suspended until payment is made.

4.6 Payments between you and your fans

Paddle is the Merchant of Record only for the subscription you purchase from FlowKreator. Sales you make through your creator site to your own customers (memberships, merch, bundles, courses or sponsor bookings) are processed through the payment account you connect to the Service. Those sales are transactions between you and your customer. FlowKreator is not a party to them and is not responsible for fulfilment, refunds, taxes or disputes arising from them.

5. Cancellation and refunds

You can cancel your subscription at any time from your account's billing settings, or by emailing support@flowkreator.com. Cancellation stops future renewals; your paid features stay active until the end of the billing period you have already paid for, and you are not charged again.

Refunds are handled under our Refund & Cancellation Policy, together with Paddle's Global Refund Policy and the consumer protection laws that apply to you. In summary, you may request a refund within 14 days of your initial purchase.

6. Your content

You keep all rights to the videos, images, text, products, course material and other content you upload to or sell through the Service ("Your Content"). You grant FlowKreator a worldwide, non-exclusive, royalty-free licence to host, store, transcode, display, distribute and otherwise process Your Content solely to operate and improve the Service and to deliver it to your audience as you direct. This licence ends when you delete the content or close your account, except for copies kept in routine backups for a limited period.

You are solely responsible for Your Content and for your dealings with your fans and sponsors, including delivering what you sell, honouring your own refund terms, collecting and remitting any taxes you owe, and complying with the laws that apply to you. You confirm that you have all rights and permissions needed for Your Content, including rights in any music, footage, images, designs or likenesses it contains.

7. Acceptable use

You may use FlowKreator only for lawful purposes and in line with these Terms. You must not use the Service, or any creator site, shop, video, course, page or rate card hosted on it, to create, upload, publish, sell or distribute content that:

• is unlawful, or promotes, facilitates or instructs unlawful activity;
• infringes or misappropriates any copyright, trademark, trade secret, right of publicity or other intellectual property or proprietary right of any person;
• is sexually explicit, pornographic, or otherwise adult or NSFW content, including nudity presented for sexual purposes;
• is deceptive, fraudulent or misleading, including deepfakes, manipulated media presented as genuine, impersonation of any person or organisation, or counterfeit goods;
• is spam, unsolicited bulk messaging, or content designed to manipulate search engines, platforms or advertising systems;
• harasses, threatens, defames or incites violence or hatred against any person or group;
• exploits or endangers minors in any way;
• sells regulated goods or services without the required authorisation, including weapons, drugs, gambling or financial products.

You also must not attempt to gain unauthorised access to the Service or other users' accounts, interfere with its operation or security, scrape it at scale, resell access to it, or circumvent any paywall, usage limit or plan restriction.

We may remove content, suspend features or close accounts that breach this section, with or without notice depending on the severity of the breach. Where a law such as the US Digital Millennium Copyright Act applies, send copyright notices to support@flowkreator.com with the subject line "Copyright notice".

8. FlowKreator's intellectual property

The Service, including its software, design, templates, player, documentation, trademarks and logos, is owned by FlowKreator or its licensors and is protected by intellectual property laws. Your subscription gives you a limited, non-exclusive, non-transferable, revocable right to use the Service for your own creator business while your subscription is active. It does not transfer any ownership to you. Feedback you send us may be used without obligation to you.

9. Third-party services

The Service integrates with third-party services such as Paddle (subscription billing), payment processors you connect for fan sales, print-on-demand suppliers you connect for merch, and video, email and domain providers. Your use of those services is governed by their own terms, and FlowKreator is not responsible for their availability, acts or omissions.

10. Suspension and termination

You may close your account at any time from your account settings or by emailing support@flowkreator.com. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if the Service is discontinued. On termination your right to use the Service ends; we will give you a reasonable opportunity to export Your Content unless the termination is for a serious breach. Sections 6 to 13 survive termination.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, FlowKreator disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or secure, or that it will generate any particular level of sales, members or revenue for you. Nothing in these Terms limits any statutory rights you have as a consumer that cannot be excluded by contract.

12. Limitation of liability

To the fullest extent permitted by law, FlowKreator will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to the Service or these Terms. Our total liability for all claims arising out of or relating to the Service in any 12-month period is limited to the amount you paid to us for the Service in that period. These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnity

You agree to indemnify and hold harmless FlowKreator and its operator from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from Your Content, your sales to your own customers, or your breach of these Terms or applicable law.

14. Changes to these Terms

We may update these Terms from time to time. If the change is material, we will notify you by email or through the Service at least 14 days before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms. The "Last updated" date at the top of this page shows when the Terms last changed.

15. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of FlowKreator is established, without regard to conflict-of-law rules, and subject to any mandatory consumer protection laws of the country where you reside. Before starting any formal proceedings, please contact us at support@flowkreator.com; most issues can be resolved quickly and informally. Nothing in this section prevents you from bringing a claim in the courts of your own country where the law gives you that right.
